These General Terms and Conditions apply to courses and educational services provided by the German branch office in Hamburg. Mandatory statutory rights, particularly those of consumers, remain unaffected.
Last revised: July 2026
1. Scope of Application
These General Terms and Conditions apply to all courses, teaching services, seminars and other educational services offered by Flying Teachers GmbH, acting through its German branch office in Hamburg. Individual agreements and the information contained in the respective course or booking confirmation take precedence over these General Terms and Conditions.
A consumer is any natural person who enters into a contract primarily for purposes that cannot be attributed to their commercial or independent professional activity. A business customer is a natural or legal person or a partnership with legal capacity that enters into a contract in the course of its commercial or independent professional activity.
Any differing or supplementary terms and conditions of the customer shall apply only if Flying Teachers has expressly agreed to their validity. In relation to business customers, this also applies if Flying Teachers does not expressly object to such terms or provides services without reservation.
2. Bookings
2.1 Conclusion of Contract
The presentation of courses and services on websites, in brochures or in other documents generally does not constitute a binding offer. By making a booking, the customer submits a binding offer to enter into a contract. The contract is concluded when Flying Teachers sends a written course or booking confirmation or when the provision of services begins. An automatically generated acknowledgement of receipt constitutes acceptance of the contract only if it is expressly designated as a course or booking confirmation.
Bookings may be made in person, in writing, by email, through an online form or via a booking system provided by Flying Teachers. Statutory requirements regarding form and information remain unaffected.
2.2 Course Content and Scope
The type, content and scope of the course, course location or online format, course fees, duration, dates, number of participants and teaching materials are specified in the course description and the course or booking confirmation. In the event of discrepancies, the course or booking confirmation shall prevail.
Flying Teachers undertakes to provide professional teaching or training services but does not guarantee any specific learning progress, language proficiency level or examination result unless such an outcome has been expressly agreed upon individually.
3. Course Fees
3.1 Payment Terms
For consumers, the prices indicated are total prices including statutory VAT, where applicable. For business customers, prices are exclusive of statutory VAT unless expressly stated otherwise.
Course fees may be paid using the payment methods offered by Flying Teachers. Invoices are payable within 20 calendar days of the invoice date without deduction, unless a different payment deadline has been agreed in the course or booking confirmation.
In the event of late payment, statutory provisions apply. Flying Teachers may charge necessary and documented reminder costs. In relation to business customers, Flying Teachers is additionally entitled to the statutory flat-rate compensation for late payment pursuant to Section 288(5) of the German Civil Code (BGB). In the event of substantial payment arrears, Flying Teachers is entitled to suspend further services until outstanding amounts have been settled, provided the customer has been informed in advance.
3.2 Teaching Materials
The costs of textbooks, licences and other course materials are included in the course fees only if expressly stated. Teaching materials procured by Flying Teachers for the customer will be charged separately. Any procurement or administration fee will be disclosed before ordering or in the booking confirmation.
Unused teaching materials may be exchanged for another level or language with the prior consent of Flying Teachers. Statutory rights of withdrawal, warranty and return remain unaffected. Digital content that has already been unsealed, activated licences and specially procured or customised materials are excluded from voluntary exchanges.
3.3 Examination Fees
Examination fees and other costs associated with examinations are not included in the course fees unless expressly agreed otherwise. Additional examination regulations and specific registration, rescheduling and cancellation conditions may apply to examinations.
3.4 Course Premises and Equipment
Costs arising from special customer requests for external classrooms, technical equipment, access permissions, security clearances or other additional services shall be borne by the customer, provided Flying Teachers has informed the customer of the costs in advance and the customer has confirmed their acceptance.
3.5 Minimum Number of Participants
Unless a different minimum number of participants is specified in the course description, group courses are generally conducted with a minimum of four and a maximum of fourteen participants. If the minimum number of participants is not reached, Flying Teachers may cancel the course, combine it with another course or offer a reasonable alternative with adjusted duration, participant numbers, course format or scheduling.
Any significant change to the agreed scope of services requires the customer's consent. If the customer does not accept the alternative offer or Flying Teachers cancels the course, fees already paid for services not provided will be refunded. Further statutory claims remain unaffected.
4. Course Locations, Formats, Equipment and Scheduling
4.1 Semester Courses
For semester or group courses, the course location, format, required equipment and timetable are specified in the course or booking confirmation. Changes are generally made by mutual agreement.
Flying Teachers may make reasonable changes to the course location, format or schedule for objective reasons, particularly in cases of teacher absence, room unavailability, official requirements or technical disruptions, provided the overall nature of the course is maintained and the customer is informed in good time. The customer's statutory rights in the event of significant changes remain unaffected.
4.2 Group Courses
Participation in a placement test is a prerequisite for assignment to a group course. Exceptions apply to designated beginner courses and cases in which Flying Teachers waives the placement test requirement.
Group courses are conducted in the format specified in the course description or booking confirmation, either in person, online or as a hybrid course. The specific course location is determined by Flying Teachers and communicated in the booking confirmation. There is no entitlement to a particular location or participation format unless expressly confirmed.
For intensive courses held daily, individual course days generally cannot be rescheduled at the request of individual participants.
4.3 Individual Lessons
For individual lessons, the customer may indicate preferences regarding location and time. If the request is received at least 48 hours before the desired appointment during normal business hours, Flying Teachers will endeavour to provide a suitable teacher at the requested time and in the requested format. An entitlement to a specific appointment arises only once it has been confirmed.
Confirmed individual lessons may be rescheduled in text form no later than 24 hours before the scheduled start. The customer should propose an alternative date at the same time. In the event of later cancellation or failure to attend, the lesson will be charged unless Flying Teachers is responsible for the cancellation or non-attendance. The customer retains the right to demonstrate that Flying Teachers has suffered no loss or a substantially lower loss.
5. Teachers
The teachers assigned to conduct courses or lessons are selected by Flying Teachers. Unless expressly agreed otherwise, there is no entitlement to the assignment or continued employment of a particular teacher.
Flying Teachers may replace a teacher during a course for objective reasons with another professionally qualified teacher. Changes to the course location or format may be made under the conditions set out in Section 4.
6. Cancellation and Termination
6.1 Semester and Group Courses
Booked semester and group courses with a fixed duration are binding. Any statutory right of withdrawal remains unaffected.
If the customer nevertheless cancels the course or does not participate, Flying Teachers may claim the agreed course fees. Flying Teachers must deduct any expenses saved and benefits obtained from reallocating the vacated course capacity. The customer retains the right to demonstrate that no remuneration is due or that the amount due is substantially lower.
A request to postpone the entire course must be submitted in text form at least 14 calendar days before the course begins. There is no entitlement to postponement unless Flying Teachers confirms it. In justified exceptional circumstances, particularly in cases of prolonged, documented illness, Flying Teachers may voluntarily offer rebooking, credit or another solution without acknowledging any legal obligation.
6.2 Individual Lessons
The rescheduling deadlines specified in Section 4.3 apply to individual and private lessons. Lessons that are not rescheduled in time or are not attended will be charged unless Flying Teachers is responsible for the cancellation or non-attendance.
A package of ten lessons must generally be used within twelve weeks of the first confirmed lesson date. Unused lessons may expire only if Flying Teachers has offered sufficient reasonable appointment opportunities during this period. Scheduling shortages attributable to Flying Teachers will extend the period for using the lessons accordingly.
The customer is responsible for arranging appointments in good time. In justified exceptional circumstances, Flying Teachers may voluntarily grant an extension, rebooking or credit.
6.3 Monthly Billing
For open-ended courses billed monthly, consumers may terminate the contract by giving one month's notice effective at the end of a calendar month. Business customers may terminate the contract by giving three months' notice effective at the end of a calendar month, unless a different individual agreement exists. Agreed minimum contract periods remain unaffected to the extent permitted by law.
Notice of termination may be given in text form, particularly by email or through a support form provided by Flying Teachers.
7. Rights to Course Materials
Course documents, concepts, exercises, presentations, curricula, examination questions and other content created by Flying Teachers or its teachers are protected by copyright and remain the property of Flying Teachers or the respective rights holders.
The customer receives a non-exclusive, non-transferable and non-sublicensable right of use to the extent necessary for personal participation in the booked course. Without prior written consent, the following activities are prohibited in particular: sharing materials with third parties, publication, reproduction beyond personal use, translation, modification, use in other courses, recording lessons, uploading materials to electronic systems, and using materials to train or further develop artificial intelligence.
8. Jurisdiction and Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). In relation to consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they habitually reside.
If the customer is a merchant, a legal entity under public law or a special fund under public law, Hamburg shall be the exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship. The same applies if the customer has no general place of jurisdiction in Germany, provided that a jurisdiction agreement is legally permissible. For consumers, the statutory rules on jurisdiction apply.
